Conservation Meeting Minutes 11/4/04

Conservation Commission
Meeting
November 4, 2004

Peg Arguimbau Chairman, Stephan Glicken, Katherine Roth and Stephen Cremer were the members present.
Hank Langstroth arrived at 7:50 p.m., and Janet Dunlap arrived at 8:05 p.m.

7:45 p.m.:  N.O.I. Hearing Continuance - A.G.M. Inc.  Proposed site preparation for construction of a single-family residence at Lot 1 Chippewa Road. DEP FILE # SE-280-460:

Jim Miller, Engineer from Miller Engineering, appeared before the Commission to represent the Applicant.
Jim presented revised plan dated 10/5/04 to the Commission. The installation of the haybale line at the 75' setback from the wetlands in the rear of the property is outlined on the revised plan.
The recorded Conservation Restriction Line located by the wetlands in the back portion of the property is defined on the revised plan.
Jim reviewed the scope of the proposed project with the Commission:
To remove the shed in the rear of the property in the least intrusive manner to the
wetlands on the site.
Due to the Conservation Restriction requirement on the site, the limit of the lawn
area in the back portion of the property is proposed at the 75' setback from the wetlands.
Native wetland and buffer species plantings are proposed for protection along the Conservation Restriction Line on the property and to restore the vegetated area at the 75' setback from the wetlands.
The Commission requested the following:
To submit a list of the proposed native wetland and buffer species plantings along the Conservation Restriction Line and the 75
To mark the corners of the recorded Conservation Restriction Line on the site with painted iron pins.
Peg called for a motion to close the Hearing and to issue the Order of Conditions pending receipt of the proposed plant list.
Stephen Cremer moved. Katherine Roth seconded. Voted. 4-0-1.
Mansfield Street /Massasoit Road Subdivision
Jim Miller reviewed the topics previously discussed during an informal meeting with the Commission regarding the proposed conceptual subdivision plan entitled,
"Mansfield Street/Massasoit Road," dated 10/13/04.
Jim stated that the landowner of one of the parcels is interested in subdividing a portion of her lot.
(The landowner, Kowalski, owns the parcel from Mansfield Street to Knob Hill Road.)
Jim explained that approval from the Planning Board would be necessary for creating a buildable lot with the frontage proposed on a Private Way.
Jim proposes to submit a conceptual design plan for the new lot to the Planning Board.
Jim plans to request the Planning Board to reopen the Public Hearing to discuss modifying the original Conservation Restriction Requirement in exchange for a larger contiguous parcel in the back portion of the property.
Jim asked the Commission to submit a letter of approval to the Planning Board regarding the proposed modification of the original Conservation Restriction Requirement on the property.
It was the consensus of the Commission to support the proposed plan as presented.

8:10 p.m., N.O.I. Hearing Continuance filed by David Wluka. Proposed replacement of an existing  retaining wall on the shore of Lake Massapoag adjacent to 64 Massapoag Ave.  DEP File # SE-280-461:

Allen Wluka was present in the audience.
Dana Clow Engineer, from Advance Concepts appeared before the Commission and presented proposed plan dated 10/1/04.

Reconstruction of the existing retaining wall is proposed to provide the support of a 12' x 30' deck located at the edge of Lake Massapoag. (The existing deck is in a failed condition. Both the concrete wall and timber retaining wall has deteriorated and is rotating outward due to frost action.)
Two courses of loose-jointed concrete aggregate 24" x 24" x 48" full blocks is proposed for reconstructing the retaining wall.
The disturbed soil area behind the proposed new retaining wall to be backfilled to grade.
      A filter fabric liner and crushed stone is proposed to relieve the hydraulic pressure and to reduce sedimentation between the joints of the wall and provide a cushion for the anticipated
      expansion/contraction movement of the retaining wall.
A conventional siltation barrier is proposed beyond the limit of work area.
The remaining disturbed soil area from the proposed construction to be backfilled to grade and a biodegradable mat such as ENKAMAT P/T is proposed for stabilization control until the planting of permanent grass.
Allen Wluka is the construction manager for the proposed project.
The Order of Conditions to state that Greg is to be contacted before the start of work to inspect the
installation of the erosion controls for the proposed project.
Peg called for motion to close the Hearing and to issue the Order of Conditions as per submitted plan.
Hank Langstroth moved. Stephan Glicken seconded. Voted. Unanimous.

8:30 p.m. Signatures:

The Commission signed bills. Order of Conditions for A.G.M. Lot 1 Chippewa Road,
DEP File # SE-280-460. Order of Conditions for Wluka, reconstruction of existing retaining wall
adjacent to 64 Massapoag Ave. DEP File # SE-280-461.
The Commission signed the deed for 5 Manor Lane.

8:40 p.m. Approve Past Meeting Minutes:

Peg called for a motion to approve the September 23, 2004 Meeting Minutes as amended.
Stephen Cremer moved. Stephan Glicken seconded. Voted. 4-0-2.

October 7, 2004 Meeting Minutes.

Stephen Cremer, Peg Arguimbau and Hank Langstroth voted in the affirmative;
Stephan Glicken, Katherine Roth and Janet Dunlap abstained; to accept the
October 7, 2004 Meeting Minutes as amended. 3-0-3.

Peg called for a motion to approve the October 21, 2004 Meeting Minutes as amended.
Katherine Roth moved. Peg Arguimbau seconded. Voted. 2-0-4.
